Objectives of the Course To enable students to analyze family law relations regulated by the Turkish Civil Code with their theoretical and practical dimensions within the framework of basic institutions such as engagement, marriage, divorce, lineage and custody, and to create solutions to legal disputes in the light of current judicial decisions.
Course Content This course covers the fundamental principles of family law, the engagement process, and the legal consequences of breaking off an engagement. After examining the establishment of marriage, the conditions and responsibilities of the spouses, the reasons for divorce, divorce cases and the material and spiritual consequences of divorce are discussed in detail. Additionally, it covers property regimes between spouses and the liquidation processes of acquired property. Finally, the issues of the establishment of the pedigree, the custody of children and the management of children ` s property are analyzed and processed in the context of concrete incident solutions and current judicial decisions.
Course Methods and Techniques The course is conducted through lectures, Q&A sessions, case studies, and the analysis of court decisions. Students discuss which facts the court relies on and how it applies the relevant statutory provisions in recent court decisions regarding divorce and custody disputes.
